Terms of Use

1. Acceptance of Terms

By accessing or using ForgeAI ("we," "us," or "our"), including our website, mobile application, and related services (collectively, the "Service"), you accept and agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Eligibility and Account Responsibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

3. Description of Service

ForgeAI provides AI-powered short- and long-form video generation, content scheduling, and publishing to third-party social platforms (including YouTube, TikTok, Instagram, and X), as well as automation resources, learning materials, and community features.

4. Subscriptions and Pricing

• Starter — $29/month.
• Pro — $79/month.
• Elite — $199/month.
• Starter Automation — $27 one-time purchase.

Payment is processed by Apple (iOS in-app purchases), RevenueCat (entitlement management), and Stripe (web-based payments).

5. Auto-Renewal and Cancellation

• Subscriptions auto-renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
• Web subscriptions: cancel through Manage Billing or by emailing support@forgeai.app.
• Apple App Store subscriptions: manage through Settings > Apple ID > Subscriptions on your iOS device.
• All purchases are non-refundable except where required by law or under our 14-day money-back guarantee for new web subscriptions.
• Apple's standard EULA applies to in-app purchases.

6. Connected Third-Party Accounts

The Service allows you to connect third-party social platform accounts (YouTube, TikTok, Instagram, X, and others) via OAuth. By connecting an account, you authorize ForgeAI to act on your behalf to publish, schedule, and manage content as you direct.

• You are solely responsible for compliance with each connected platform's own Terms of Service and Community Guidelines.
• You may revoke ForgeAI's access at any time via the Connect Accounts page or via the platform's own permissions settings (e.g., Google permissions).
• We are not responsible for actions, downtime, or policy changes of third-party platforms.

7. Acceptable Use

You agree NOT to use the Service to create, schedule, or publish content that:

• Is illegal, infringes third-party rights, or violates any law.
• Depicts real, identifiable individuals (deepfakes) without their explicit, verifiable consent.
• Contains hate speech, harassment, sexual content involving minors, or incitement to violence.
• Constitutes spam, scams, or deceptive marketing.
• Misrepresents AI-generated content as authentic in contexts where doing so causes harm.
• Violates any connected platform's rules (YouTube, TikTok, Instagram, X, etc.).

You also agree not to share account credentials, attempt to reverse- engineer the Service, abuse rate limits, or use automated tools to access the platform without authorization.

8. User Content and License

You retain ownership of all content you submit to the Service (prompts, scripts, uploaded media) and all content the Service generates on your behalf.

By using the Service, you grant ForgeAI a worldwide, non- exclusive, royalty-free license to host, store, process, transmit, and display your content solely as necessary to provide the Service — including transmitting it to third-party platforms you instruct us to publish to.

This license terminates when you delete your content or your account, except to the extent retention is required by law.

9. Intellectual Property

The ForgeAI platform, software, design, blueprints, templates, and brand assets are owned by ForgeAI and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works of our proprietary content without explicit written permission.

10. Feedback Assignment

If you submit suggestions, feedback, or ideas to ForgeAI, you assign all rights in such feedback to ForgeAI and we may use it without restriction or compensation.

11. Termination

We may suspend or terminate your account for violations of these Terms or for misuse of the Service. You may terminate your account at any time. Upon termination, your right to use the Service ends immediately.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. ForgeAI does not guarantee uninterrupted access, error-free operation, or specific business or financial outcomes from use of the Service or content generated through it.

13. Limitation of Liability

To the maximum extent permitted by law, ForgeAI's total liability arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim or (b) USD $100. ForgeAI shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

14. Indemnification

You agree to indemnify and hold harmless ForgeAI and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located in Delaware, unless otherwise required by applicable consumer protection law.

16. Account Deletion

You may delete your account at any time from the Account page. Cancel any active subscriptions before deletion to avoid continued billing. Apple App Store subscriptions must be canceled through Apple's subscription management.

17. Changes to Terms

We may modify these Terms at any time. Material changes will be reflected by an updated "Last updated" date. Continued use after changes constitutes acceptance.
